The plaintiff was a pedestrian struck by a car while crossing in a crosswalk. The plaintiff sustained massive orthopedic injuries and required a month and a half of hospitalization and months of rehabilitation following the accident. The case settled for the full available policy limits of $1,250,000 prior to depositions. The handling attorney from Block O’Toole & Murphy set a deadline for the offer of the full policies and indicated that once the demand was withdrawn the case would not settle and the case would be tried to verdict, whereupon excess damages would be sought. The defendant’s insurance company tendered the full available policy prior to the expiration of the demand deadline.
