$3 Million Settlement Reached in Ladder Fall Case

Block O Toole & Murphy is pleased to announce that two of its attorneys have reached a substantial settlement of $3 million for a ladder fall incident. The then-41-year-old Plaintiff received the settlement after receiving serious wrist, facial, and cognitive injuries due to a fall from a ladder at a construction site in Manhattan. The case was handled by firm partner Daniel P. O’Toole and Scott Occhiogrosso.

The Plaintiff was working on renovating a luxury apartment at a residential cooperative building located at 34 East 30th Street in Manhattan when the accident occurred. The Plaintiff and two co-workers were standing on ladders while snapping a chalk line on a ceiling beam when he fell from the ladder to the floor. The worker struck his wrist and head on the floor and sustained injuries to both. The Plaintiff suffered a comminuted fracture of the distal radius bone in his dominant right wrist, which required open reduction and internal fixation. The Plaintiff also suffered numerous non-displaced facial and skull fractures, although these did not require surgical intervention. Furthermore, the worker alleged that he suffered a traumatically-induced cognitive disorder with a psychological component from the fall.

In addition to seeking compensation for the immediate costs of the accident, the Plaintiff also made a claim for future medical expenses and future lost wages, alleging that he could not return to work as a carpenter. Despite claims by the Defendant that the Plaintiff was fully healed, did not suffer the cognitive injuries alleged, and could return to work as a carpenter, the experienced New York construction accident attorneys at Block O Toole & Murphy reached the substantial $3 million settlement in mediation.
