After shopping at a local grocery store, the victim was driving his minivan back to his home when he was involved in a crash with a school bus. Shortly before the accident, the Plaintiff’s vehicle and the bus were heading towards each other on 20th Avenue in Brooklyn when they reached an intersection with no traffic control devices, including stop signs and traffic lights. The bus turned left and smashed into the driver’s side of the minivan, resulting in serious neck and back injuries for the driver.
The injuries sustained in the crash required two spine surgeries and extensive physical therapy. The surgeries included non-invasive laser ablasion of the L3/L4 level of Plaintiff’s lower back and an anterior discectomy and fusion at the C5/C6 level in Plaintiff’s neck. The $1.49 million was awarded to the victim for past and future medical costs, as well as his pain and suffering. The victim was working as a construction laborer and livery car driver at the time of the accident, but did not have a claim for lost earnings.
