Plaintiff sustained a fractured skull and multiple hematomas causing him to undergo a craniotomy/craniectomy and causing permanent cognitive disorder. The Hospital records state that Plaintiff was not wearing a helmet at the time of the accident. Plaintiff was not wearing a helmet at the time of the accident. Plaintiff had retrograde amnesia and could not testify to his wearing a helmet.
