$1,700,000 Settlement for 58-Year-Old Pedestrian with Spinal Injuries After Crash

DESCRIPTION OF CASE
Plaintiff was a pedestrian, walking to work in the Bronx, when she was struck by a large left turning truck. Plaintiff contended that she never saw the truck before it struck her, and the truck driver testified that he never saw the Plaintiff despite looking both ways before turning.

INJURIES/DAMAGES
Plaintiff alleged injuries to her neck and back, including multiple herniated discs in both areas of her spine. After physical therapy failed to relieve her symptoms, Plaintiff underwent surgery to both her cervical and lumbar spine, and claimed damages for her pain and suffering, as well as her past and future related medical expenses. The defense contested Plaintiff’s damages claims, arguing that Plaintiff’s injuries were minor and did not require surgical intervention or any future treatment.

VERDICT/SETTLEMENT AMOUNT
This case settled for $1,700,000. Notably, the case settled over two years before the expected trial date.

NOTE
This case was handled by firm Partners Stephen J. Murphy and David L. Scher.
