$1,175,000 Settlement For HVAC Mechanic Who Suffered Tibia Fractures

Accident
Our client was an HVAC mechanic who had to access the roof of a one-story building to perform his work. He used an extension ladder that was leaned against the side of the building’s exterior. While beginning to descend the ladder from the roof toward the ground, the top of the ladder began to slide and tip over, causing our client to fall approximately 6 to 8 feet to the ground below. We sued the owner of the building, alleging violations of New York Labor Law Section 240(1).

Damages
Our client landed on his feet, causing fractures to his left and right tibia. He elected to have surgery on both fractures, in order to be able to bear weight and begin his rehabilitation more quickly. The surgeries were successful. He was able to return to the same job in less than one year, but reported continuing, on and off leg pain. We made claims for his pain and suffering, and various future medical costs we alleged would be necessary.

Settlement
The case settled prior to trial for $1,175,000.
